KCLS Terms of Service

Effective Date: May 1, 2026

These Terms of Service ("Terms") govern your use of services provided by KCLS ("we," "us," or "our"), a Missouri limited liability company providing lawn irrigation services in the Kansas City metropolitan area. By requesting an estimate, scheduling service, or otherwise engaging with KCLS, you ("Customer," "you," or "your") agree to these Terms.

1. Services

KCLS provides residential and commercial lawn irrigation services, which may include system installation, repair, maintenance, seasonal startup and winterization, backflow testing, and related services. Specific services to be performed will be described in the estimate, work order, or invoice provided to you.

2. Estimates and Quotes

Estimates and quotes provided by KCLS are based on the information available to us at the time, including site conditions observed during inspection. Final pricing may vary if site conditions, scope, or materials change once work begins. We will communicate any material changes to you before completing additional work.

Estimates are valid for thirty (30) days from the date issued unless otherwise noted in writing.

3. Scheduling and Cancellation

Service appointments are scheduled by mutual agreement. KCLS may reschedule appointments due to weather, equipment availability, or other operational considerations and will provide reasonable notice when this occurs.

If you need to cancel or reschedule, please notify us at least 24 hours in advance when possible. Cancellations made with less than 24 hours' notice may be subject to a trip charge.

4. Payment Terms

Payment is due upon completion of services unless other arrangements have been agreed to in writing. We accept payment by the methods identified on your invoice. Past-due balances may accrue late fees as permitted by Missouri law.

5. Property Access

By scheduling service, you authorize KCLS personnel to enter your property as reasonably necessary to perform the agreed services. You are responsible for ensuring that pets are secured, gates are accessible, and any private utilities or hazards are clearly marked or communicated to us in advance.

6. Limitation of Liability

KCLS performs work using reasonable care and industry-standard practices. To the fullest extent permitted by law, our liability for any claim arising out of or related to our services is limited to the amount paid by you for the specific service giving rise to the claim. KCLS is not liable for damages caused by pre-existing conditions, undisclosed underground utilities or obstructions, acts of God, or third-party actions outside our reasonable control.

7. SMS / Text Message Program Terms

The following terms apply specifically to KCLS's text messaging program.

Program description. When you provide your phone number to KCLS, you are enrolled in our SMS program and may receive text messages from us regarding our services. These messages may include appointment confirmations, "on my way" notifications, quotes, invoices, payment reminders, service updates, and follow-up communications.

Consent. By providing your phone number to KCLS, you expressly consent to receive text messages from us at that number. Consent is not a condition of purchasing any goods or services.

Message frequency. Message frequency varies based on your service relationship with KCLS.

Message and data rates. Message and data rates may apply depending on your mobile carrier and plan. KCLS does not charge for the messages we send, but your carrier may.

Opt-out (cancel). You can cancel the SMS program at any time by replying STOP to any text message from us. After you reply STOP, you will receive one final message confirming you have been unsubscribed, and you will no longer receive text messages from us. To rejoin, reply START or contact us directly.

Help. For help, reply HELP to any text message from us, or contact us directly using the information at the end of these Terms.

Supported carriers. Our SMS program is compatible with all major U.S. mobile carriers, including AT&T, T-Mobile, Verizon, and others. Carriers are not liable for delayed or undelivered messages.

Carrier disclaimer. KCLS is not responsible for delays, failures in delivery, or any other issues related to the transmission or receipt of text messages. Delivery is subject to effective transmission by your mobile carrier and is not guaranteed. By participating in our SMS program, you acknowledge that KCLS is not liable for any damages, losses, or issues arising from delays, non-delivery, or technical issues with text messages.

Eligibility. You must be at least 18 years old and the authorized user of the mobile phone number you provide.

Privacy. Your privacy matters. Information collected through our SMS program is handled in accordance with our Privacy Policy, available at [INSERT PRIVACY POLICY URL]. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

8. Changes to These Terms

We may update these Terms from time to time. The current version will always be posted at this URL with an updated "Effective Date." Continued use of our services after changes constitutes acceptance of the updated Terms.

9. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be brought in the state or federal courts located in Missouri.
